Drug Crime Charges in Beverly Hills

Beverly Hills Criminal Lawyer Fighting For You!

California has come to be known as one of the easiest states in which to obtain medical marijuana. However, even when a person is granted the right to possess, cultivate, and/or use medical marijuana, they must do so within very strict regulations or be charged with a drug crime. Any other possession of marijuana, or any other illegal drug or controlled substance, is a serious crime in the state of California and will be harshly dealt with.

Types of Drug Crimes and Sentencing in California

According to the California Uniform Controlled Substances Act, a drug offense can fall under one of five different “schedules.” Schedule I includes drugs such as GHB (liquid ecstasy), marijuana, heroin, peyote, mescaline, and BZP. Possession of such drugs can result in up to seven years in prison, whereas trafficking and/or production can bring about a life sentence. Schedule II includes drugs such as cocaine, opium, oxycodone, morphine, codeine, and amphetamines. Possession and trafficking of such drugs can bring up to five years in prison, exportation can bring up to 10 years, and production can result in a life sentence.

Schedule III drugs include anabolic steroids, buprenorphine, and ketamine. For such drugs, possession is a minimum of three years in prison, and trafficking, exportation, and production are a maximum of 10 years. Schedule IV includes drugs like Xanax, Valium, and modafinil. For Schedule IV drugs, possession is not actually illegal, but acquiring such a drug is illegal. As for trafficking and production, the result is a minimum three-year prison sentence, and exportation brings a maximum of 10 years. Finally, Schedule V includes drugs such as cough suppressants containing small amounts of codeine, pregabalin ( Lyrica), and pyrovalerone. Exportation of these drugs results in a maximum of three years in prison.
