California Penalties for Hit and Run Charges

While drunk driving charges in California are already serious, an additional hit and run allegation can lead to increased penalties. According to Vehicle Code Section 20001, a driver who gets into an accident with another car has a duty to stop and assist the other driver, as well as give them necessary information. A driver that does not follow this procedure may be charged with hit and run.

If the hit and run did not involve any serious injuries or death, then the hit and run could be classified as a misdemeanor or a felony, known as a wobbler offense. For a misdemeanor, a conviction could result in up to a year in jail, however; a felony could result in three years in prison and fines of up to $10,000. A hit and run accident that involved a serious injury or death may also be filed as a wobbler, depending on the accident. In this case, the driver can face penalties of at least 90 days of imprisonment and fines of $1000 or more. A hit and run with no injuries can only be processed as a misdemeanor.
